Plan ahead

Mistakes that stall an Orange County kitchen

  • Demolition before the HOA says yes

Where your CC&Rs call for review, wait for the association’s written approval before anything comes out.

  • Bids for different jobs

CSLB says to get at least three written bids on the same plans and scope, and not to take the lowest one automatically.

  • Paying ahead of the work

California law says progress payments may not run ahead of the work done or the materials delivered.

1 more to avoid
  • Changes agreed out loud

Put every change to the contract in writing, with its price, before the work is done.

Hiring

What to ask before you sign

  1. What is your license number?

CSLB warns a number alone does not prove a license is valid. Check it online and ask for the pocket license.

  2. Which license class do you hold?

CSLB says a remodel with plumbing, electrical and carpentry under one contract calls for a B General Building contractor.

  3. Who pulls the permits, and are the fees in the price?

Both questions are on CSLB’s homeowner checklist.

3 more questions
  1. When will work start and end?

The written contract should give both dates.

  2. May I see your certificate of insurance?

    CSLB suggests asking for one.

  3. Can I call three recent local clients?

CSLB suggests at least three local references.

In California, work of $1,000 or more in labor and materials combined, or that needs a permit, must be done by a licensed contractor. Check the CSLB website.

HOA

Getting your association’s approval

From the Irvine villages to the South County master plans, many homes here sit under an association. Your CC&Rs say what it reviews; where they call for approval, get it in writing before work starts. Owners in Anaheim, Orange, Santa Ana and the north can find their city on the areas page.

California Civil Code 4765 says the decision must be in writing, made in good faith, and reached by a fair, reasonable and expeditious procedure. It may not be unreasonable, arbitrary or capricious.

Contracts

What California law puts in your contract

A home improvement contract over $500 has to be written and signed before work begins. The law also sets these terms:

  • Three business days to cancel, or five if you are 65 or older
  • A payment schedule that never gets ahead of the work
  • A mechanics lien warning and notes on insurance and change orders

Worth knowing

An unlicensed contractor cannot sue to be paid in California, and a homeowner who paid one can sue to recover the money.
